- Unwanted and unwelcome sexual advances or conduct (e.g., remarks) on the job that create an intimidating, hostile or offensive working environment. Sexual harassing behavior ranges from repeated offensive jokes to a workplace full of pornography to sexual assault. Sexual harassment is a private nuisance, an unfair labor practice, and, in some states, a civil wrong (tort), and is prohibited by the federal Civil Rights Act of 1991 as well as by state laws.
